Form W-7 and the ITIN Application

An ITIN identifies an individual for US federal tax purposes when that person needs a taxpayer number and is not eligible for a Social Security number. The application is evidence-led: start with the tax reason, then prepare the identity documents.

Confirm that an ITIN is needed

An ITIN is not a general business licence or proof of work permission. Explain the specific federal tax purpose before applying. An EIN identifies a business, while an ITIN identifies an individual. Having one does not automatically remove the need for the other. Before deciding, write a short fact sheet covering the owners, the activity, the places involved and the intended outcome. Separate confirmed facts from assumptions that still need checking. Give the reviewer the actual documents rather than a summary assembled from memory. This makes the advice easier to apply and reduces the chance that a crucial detail is overlooked.

Follow the documentary instructions

Form W-7 has detailed rules for supporting identity and foreign-status evidence. Check whether original documents, acceptable certified copies or an authorised assistance route fit the application. Do not send an ordinary photocopy on the assumption that it will satisfy the IRS requirements. Create a working folder with the source records, the questions raised and the answer received. Check that names, addresses and periods agree across documents before anything is submitted. If the instructions are unclear, resolve that point with the relevant authority or a suitable adviser. A documented decision is easier to revisit when the business changes than an informal assumption.

Link the application to the tax position

The application generally accompanies a federal return unless an exception applies. Review the relevant exception and evidence before separating the two. Keep copies, record dispatch details and plan around the practical consequences of sending identity documents away. Check renewal requirements before reusing an older ITIN. Assign a named person to the next action and record how completion will be evidenced. Keep accepted filings, correspondence and supporting calculations together. Revisit the arrangement when ownership, location or activity changes. Where more than one country or authority is involved, ask who will coordinate the work so each adviser understands the wider picture before relying on another person’s conclusions.

Check the official guidance

Rules and provider requirements can change. Check the current official guidance and seek advice on your circumstances before acting.

Is an ITIN the same as an EIN?

No. An ITIN identifies an eligible individual, while an EIN identifies a business.

Does every W-7 application need a tax return?

A federal return generally accompanies the application unless a documented exception applies. Check the current instructions.
