Amazon Sales Tax: Review the Seller’s Own Position

Marketplace collection simplifies some transactions but does not answer every sales-tax question. Amazon sellers should map inventory, direct sales and state connections before deciding what registrations or returns remain necessary. The answer is state-specific and can change as the business grows.

Locate inventory and business activity

Keep records showing where inventory is held and where the company has people or other operations. Marketplace fulfilment can create a more complicated footprint than the seller’s mailing address suggests. Review the relevant states using their official guidance and do not assume formation in one state limits obligations to that state. Before deciding, write a short fact sheet covering the owners, the activity, the places involved and the intended outcome. Separate confirmed facts from assumptions that still need checking. Give the reviewer the actual documents rather than a summary assembled from memory. This makes the advice easier to apply and reduces the chance that a crucial detail is overlooked.

Separate marketplace and direct sales

Identify what the marketplace collects and which transactions fall outside its collection arrangements. Direct website sales, wholesale sales and other channels may need different treatment. Confirm whether registrations or returns remain necessary in states where marketplace-facilitator rules apply. Avoid registering everywhere without first assessing the facts and ongoing administration. Create a working folder with the source records, the questions raised and the answer received. Check that names, addresses and periods agree across documents before anything is submitted. If the instructions are unclear, resolve that point with the relevant authority or a suitable adviser. A documented decision is easier to revisit when the business changes than an informal assumption.

Keep reconcilable channel records

Retain sales, refunds, tax reports, exemptions and inventory movement information. Reconcile gross sales to payouts and preserve marketplace collection evidence. Review state exposure when adding products, warehouses or sales channels. A documented review is more useful than a blanket claim that the platform handles all sales tax. Assign a named person to the next action and record how completion will be evidenced. Keep accepted filings, correspondence and supporting calculations together. Revisit the arrangement when ownership, location or activity changes. Where more than one country or authority is involved, ask who will coordinate the work so each adviser understands the wider picture before relying on another person’s conclusions.

Check the official guidance

Rules and provider requirements can change. Check the current official guidance and seek advice on your circumstances before acting.

Does marketplace tax collection settle every seller obligation?

Not necessarily. State registration, returns and direct-channel activity require their own review.

Why does inventory location matter?

Where inventory is stored can affect the seller’s state connections and should be checked against the relevant state guidance.
